Senator Abbo: INEC Does Not Have the Power to Invalidate a Declared Election

Senator Ishaku Abbo, who represents Adamawa North Senatorial District, spoke on Channels

Television's breakfast show 'Sunrise Daily' on Monday about the recent Adamawa State governorship election. According to the senator, the Independent National Electoral Commission (INEC) is prohibited from nullifying the collated results of the election under the Electoral Act 2022.

He argued that INEC did not have the authority to nullify an already announced election result. Senator Abbo also referred to section 149 of the Electoral Act of 2022, which states that any error or defect arising from actions taken by an official of the Commission remains valid unless otherwise challenged and declared invalid by a competent court of law or tribunal.

The senator emphasized that it was futile to challenge an already announced election result and accused the ruling party in the state of electoral infractions. He stated that the Fufore elections were contentious, and while they prepared for a free and fair election, the PDP did not. He claimed that the PDP prepared to bypass the elections and compromise certain officials.

In summary, Senator Abbo believes that the INEC's proclamation regarding the nullification of the collated results of the Adamawa State governorship election is insignificant according to the Electoral Act 2022. He insisted that the results have already been announced and that challenging an already announced election result is pointless.
